Las Vegas, Nevada real estate investors who purchased HOA liens in real estate auctions and took advantage of the HOA lien super priority status to extinguish first and subsequent mortgages in order to purchase foreclosed homes at bargain prices have suffered another legal setback. In a 2-1 decision, the 9th Circuit court has ruled that Nevada law requiring mortgage lenders to be alerted of a foreclosure by a homeowners association only if the lender had requested notice is unconstitutional. The panel said the requirement of an “opt-in” request is a violation of the 14th Amendment requiring due process. Now Nevada Supreme Court has to take up the case again and if this ruling is upheld it can nullify the sales so these homes would go back to the foreclosure process …

Las Vegas real estate investors, HOA is your best friend

Las Vegas real estate investors have no better friend than a strict HOA (Home Owner Associations) Investing in Las Vegas homes or condos which have a strict home owner association (HOA) is one of the best tools to increase the odds of future appreciation Before moving to Las Vegas I lived in Nebraska for 20 years, much of it in a log home that was 1000 feet from the nearest road, free as a bird and private as private gets. No HOA there as in many other parts of United States. When we chose to buy a home in a Las Vegas common interest community with an HOA, I had serious reservation about a home owner association dictating to me what I could or couldn’t do with my own property, …

Investing in Las Vegas condos for cash flow

Investing in Las Vegas condos provides investors with higher cash flow First let’s talk about why Investing in Las Vegas condos is a very good idea. Residential real estate here has been undervalued by about 18%-20%. This makes Las Vegas condos a good real estate investment opportunity. But luxury condos, such as condos at Lake Las Vegas, are being marketed for 20 cents on the dollar. As for owner occupied condo investors, in the last blog post Invest in Las Vegas owner occupied homes, I talked about making double digit cash …
